What is the FMLA?
Generally, the Family and Medical Leave Act of 1993 (FMLA) requires employers of a certain size are required to allow a total of up to 12 work weeks of unpaid leave during any 12-month period for the following purposes:
- The birth of a son or daughter of the employee and the care of such son or daughter;
- The placement of a son or daughter with the employee for adoption or foster care;
- The care of spouse, son, daughter, or parent of the employee who has a serious health condition; or
- A serious health condition of the employee that makes the employee unable to perform the essential functions of his or her positions.
Conflicts Regarding Leaves of Absence
Employment conflicts regarding FMLA or other types of leaves of absence (such as leaves for military service) often arise when:
- Employers refuse to allow a particular leave of absence, or when;
- An employer does grant a leave of absence, but at the end of the leave, the employee’s job is no longer available due to outsourcing or downsizing; or
- An employer informs an employee after the leave of absence is completed that that employee has used up all vacation or sick time or both, without prior notification.
